What Should I Do If My Employer Failed To Pay Me Wages?

do employment law. What Should I do if My Employer Failed to
Pay me Wages? You have two options at this point. First you could file a complaint with the
Arizona Labor Department. They have the power to investigate these kinds
of claims and order your employer to pay you the money they should have paid you. OR, you can hire an attorney. Many employees who are owed let’s say $500,
are hesitant to hire an attorney because they are expensive. But what you should know, as an employee is
that many attorneys are willing to take these cases because an employee can get three times
the amount of wages they should have been paid and they can also recover their attorney’s
fees. Courts are very inclined to help employees
who should have been paid and weren’t. They do tend to award three times wages and
attorney’s fees when the employee can clearly prove that they worked and weren’t paid. What Remedies are Available to Employees? As I said employees can get three times the
amount of wages and attorney’s fees. Employees may also have other claims for example,
if you weren’t paid your final paycheck because you got into some kind of argument with your
boss. You may also have a claim for failure to pay
minimum wage because you worked let’s say 20 hours and weren’t paid any money for that
time. Courts are even more harsh when employers
fail to pay minimum wage and the laws are also even more favorable to employees in those
situations. For example, employees can recover a mandatory
award of attorney’s fees when their employer doesn’t pay them minimum wage. This gives attorneys a lot of leverage to
settle these kinds of claims early on because employers know if they go to trial and lose,
they are going to have to pay the employees attorney’s fees.

  • Can I sue for pain and suffering after getting up in the morning while suffering from depression for 2 weeks to meet my obligations as an employee while the company profited 5,000-8,000 from my labor and then when it was time to receive my wages the check wasnt there. This isn't just abuse on a grander scale , it's outright criminal and how can I get justice?

    This guy is feeding you a load of crap. You won’t get 3 times your wages that weren’t paid. You can get attorneys fees, but you will only pocket exactly what is owed to you, unless you can prove that not receiving your earned wages lead to even greater monetary losses.

  • My boss is such a liar if he gives me his word i'll get paid tomorrow 100% then there's about a 20% chance I'll actually get it tomorrow and about a 5% chance I'll ever get it

  • What would be proof of working hours and not getting paid, right now it’s 5/6/19 and my boss had us at monthly payroll then moved to weekly. She paid us our Jan payroll dated 2/25 by the end of March ex 500 on 2/26 500 on 3/10 and remainder by the end of March then hasn’t fully paid us February payroll dated 4/25 she has paid a partial amount of that. As for the weekly March payroll it’s been paid throughout April instead of weekly in March . And nothing was received for April weekly payrol until 5/3 I received paydays 4/22 she told us she would be caught up and keep paying us minimum amounts or one check every two weeks what can I do!?

  • Im homeless with no transportation, I been working for a landscape company, under the table, when the job was finished, my boss was no where to be seen, no pay, no good job, no slap on the back for doing a good job, working in the AZ heat, in summer.I feel he used me because I'm so venerable, and easy to manipulate , because of my living circumstances.

  • My employer lost my application so I worked 3 weeks for nothing. I then have to fill out an application again. My manager did not express to me that this second application had to be filled out again within a specific and very short time frame and before I could be paid. From this point I had to wait an additional week for my paycheck. Now I'm waiting 4 weeks. After the 4th week I come back to my job for my paycheck and they tell me the second application I did doesn't count and I have to fill out another application. I fill out a third application and have to wait an additional 5th week for a pay check they hopefully pay me for this Friday. I have no money I can use and I have been out of work for two weeks because I don't have the means to get there since they didn't pay me and they said they couldn't even mail me the check. I have to travel 21 miles back there each time to check if they have a paycheck for me. I have no relatives who will let me borrow money. Is there any kind of legal action I can take on all of this?

  • I had to sleep on the job, been working days and nights, and when I gave the 2 week notice the boss fired me and refused to pay.

    I worked for a friends dad for 3days and I never received a punch card or any of that but there’s people who are witnesses. And his son drove me there and back for 3days. I didn’t fill out any paperwork or that stuff. Could I still sue?
